Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity:
A. Cancellation Policy
Right of withdrawal
You have the right to withdraw from this contract within thirty days without giving any reason.
The cancellation period is thirty days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us (HEAT OF°, c/o Stonewall GmbH, Lise-Meitner-Straße 13, 72622 Nürtingen, Germany, email: support@heatof.com ) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.
Consequences of the revocation
If you cancel this contract, we will reimburse all payments received from you for the returned goods without undue delay and at the latest within seven days from the day on which we received your cancellation notice.
Orders with a merchandise value below €99 will incur shipping costs.
These shipping costs will not be refunded in the event of a cancellation.
Orders over €99 qualify for free shipping. In this case, you will not incur any shipping costs.
For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.
We may refuse reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties and functionality.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to consumers who are not citizens of a Member State of the European Union at the time of conclusion of the contract and whose sole residence and delivery address are outside the European Union at the time of conclusion of the contract.
Affiliated/financed businesses
If you finance this contract with a loan and later cancel it, you are also no longer bound by the loan agreement, provided both contracts constitute a single economic unit. This is particularly likely to be the case if we are also your lender or if your lender uses our services for the financing.
If the loan has already been disbursed to us when the cancellation takes effect or when the goods are returned, your lender will assume our rights and obligations under the financed contract with respect to you regarding the legal consequences of the cancellation or return.
The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g., securities, foreign exchange or derivatives).
If you want to avoid a contractual obligation as much as possible, make use of your right of withdrawal and also cancel the loan agreement if you are entitled to a right of withdrawal for that as well.
